Learning outcomes
The protection of individuals with regard to the processing of personal data is one of the fundamental rights in the EU. The Constitution of the Czech Republic, the Charter of Fundamental Rights of the European Union (Article 8 (1)) and the Treaty on the Functioning of the European Union (Article 1 (1)) provide that everyone has the right to the protection of personal data concerning him or her. This course represents an excursion to the past of privacy, especially when L. Brandeis and S. Warren described privacy as "the right to undisturbed mental peace, not to disturb and disturb a person in his or her dwelling, to protect himself from outside disturbances and interference". Students will be informed on important documents that have had a major impact on shaping the individual's right to privacy in the digital age as an integral part of human rights protection. A substantial part of the course is devoted to new legislation for the protection of individuals' personal information - General Regulation of the European Parliament and of the Council 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, known as "GDPR"). The course is a follow-up to the seminars ÚAI/634 in clarifying the obligations that the General DP Regulation imposes on entities processing personal data of natural persons. They will also be explained the rights they have in order to gain an overview of who, what and how they work with their data and to effectively exercise those rights. Practice of interpretation of current legislation on personal data protection will be demonstrated on examples of case law of Czech and European courts. Explanatory and practical documents from supervisory authorities (e.g. the Office for Personal Data Protection) as well as the European Data Protection Board (EDPB) will also be presented. The Institute of Applied Informatics of the Faculty of Science of the University of South Bohemia carries out these specialized seminars for students of computer science and informatics, for representatives of personal data controllers and processors (if need be), the aim of which is to acquaint participants with the new modern legislation on personal data protection in the EU and its impacts on the practical situation of today's society.
